According to ComputerWorld: ” Federal agents on Thursday said they arrested 11 people in six states in a crackdown on H-1B visa fraud and unsealed documents that detail how the visa process was used to undercut the salaries of U.S. workers.”
“The arrests were carried out by federal, state and local agents working in Iowa, California, Massachusetts, Texas, Pennsylvania, Kentucky and New Jersey. The government’s action “is the result of an extensive, ongoing investigation into suspected H-1B visa fraud, mail fraud and conspiracy,” said Matthew Whitaker, the U.S. attorney for the Southern District of Iowa, in a statement.”
“The company that seemed to get the most attention from federal authorities is Vision Systems Group Inc., which authorities said had its principal places of business in Somerset and South Plainfield, N.J., and an office in Coon Rapids, Iowa. The company was cited in a 10-count indictment.”
ComputerWorld worte on October, 2008: “An internal report by the U.S. Citizenship and Immigration Services (USCIS) examining the H-1B visa program has found evidence of forged documents and fake degrees, and even “shell” companies giving addresses of fake locations.”
Update: The government arrested on conspiracy and mail fraud Shiva Neeli in Boston, Ramakrishna Maguluri in Atlanta, Villiappan Subbaiah in Dallas, Suresh Pola in Pennsylvania, Karambir Yadav in Louisville, Ky., Amit Justa and Venkata Guduru, both in New Jersey, and Vijay Myneni in San Jose. Its about time they started cracking down on these jackasses. A lot of these small Indian shops (and big ones are no exception) have been encouraging these things for a really long time now. Faked resumes, experience letters, degrees, payroll.. any piece of paper, and not to mention millions of dollars worth of software they use for training. They prowl on immigrants and fresh grads, who’re looking for jobs, turn then into tech consultants within a week with some crappy training given by another ‘consultant’, who’s probably another chap peddling a fake resume.. or two.. you know.. to diversify. Amazing. I wasn’t even aware of this. With the stringent requirements for visa and the punishments associated with federal crimes of this magnitude, I am surprised anyone would mess around with immigration.
Madcat: Just because people are crappy doesn’t mean they are illegal. In some countries you can easily buy your degree. Those guys laugh at you for being honest and working hard and eventually try to take advantage of your hard work by taking credit and trying to make you look like a fool.
Nevertheless, I have met very good people on H1-B who really kicked ass and others who were total duds.

It’s sad to note that US Federal Agents have woken up so late. They should have curbed these trends that were rampant over the last 10 years. In the process US has lost an opportunity to get quality professionals from India and elsewhere. I do not blame the Consulting shops for having exploited these loop holes in the US immigration laws. I think US should continue to remain open and vigilant when it comes to hiring quality IT professionals.

I have seen a lot of Indian IT programmers coming here with H1B visa. Some of them are good, but many of them are really really suspicious. They apparently have no experience, they don’t know any fundamental computer science knowledge but they can answer some buzz words IT questions, they don’t have any coding experience and write crap codes. It is really surprising how these people got their degrees. Now I understand why — their degrees are just fake !

I would like to leave a comment on the so-called “stringent” control systems of USCIS. Do not just look from your perspective. A normal person like you and me are able to get this sort of sensitive information. Dont you guys think the USCIS and SEVIS know about this earlier? I feel,when something fraudulent happens, it is malpractice on both sides. There should have been some culprits inside the US Immigration too who are helping those Consultant and big-time companies. How can some other country find the loop-holes and manage to do all this from decades without the help from the “inside people”??…Think for a second guys! I am not supporting anyone, am just giving my thoughts.
And here is one more, fake certificates and degrees are available readily on the internet “in the US and made by the US citizens” too, then does it matter if they got those from India or US? Do you know that the interview process in India is far more complex than here! All those qualified IT people are getting employed in India. The not-so-qualified are the ones that are coming to the US.
When employers in the US interview them, they should also look at their course work, bachelor`s degree major, do some research on the university they came from and such stuff. Every company does a background check on new-hires, is that just for namesake, or do they really do the “check”. Why cannot they find this fraud if they did a stringent check?. Think about it guys. Every company does`nt matter India or US or any other country, does FRAUD to a certain extent for saving their money. I can bet on it.

I am from Germany, an IT Consultant in Manila for four years now. Mostly, multinational IT companies ( Accenture, IBM, headstrong) hire third party group to do background investigation on prospective applicants, verification of school records, previous employments and even applicants neighborhood. I was shocked to know when i read a confi report from HR, that even the neighborhood’s comment is listed e.g. applicant is moron, drunk every saturday night, fights with his wife during payday or could be positive the applicant is part time preacher, never get talk to anyone in the neighborhood like that info. USCIS should hire third party investigators in each applicant’s country of origin and do the same,cost would be shouldered by the employer offcourse.

#15- There are many hard working American workers. IT is famous for long hours.
The offshoring company typically charges $30 an hour. This is $30/hour X 40 hours/week * 52 week/year = $62,400 per year. The offshore worker may only be receiving 10,000, but from a business perspective, the cost is 62,400 per offshore worker per year. The offshoring company keeps the difference.
Add to that the number of extras such as liasons,translators, training, more quality assurance, etc. and you can see it costs more to offshore. The other cost is time-to-market, which takes longer with offshoring.
The other point to make is that the US workers credentials such as University degrees are accredited in the United States. The curriculum must meet standards for the University to issue degrees. The education system is more expensive in the United States for the US worker. This cost is passed to the company at the workers rate of salary. These Universities are trusted because they are accredited. It is fairly easy for the employer to check the credentials of the US worker by asking the University for a confirmation of the degree.
Another point to make is that most of the products and services are sold to the United States companies, a much larger market share, then developing countries. Having the sales people close to the developers makes the firm agile and flexible to many changes and wants of the customer in a competitive world.
Other points are protections such as legal protections, copyright, patents, etc that the company may want to keep close.
So you can see, it is beneficial from this point of view to have the IT workers in the US.
I think a compromise may be to have the IT unique items for the developing country developed in that country, such as language, graphic symbols, presentation to the developing country’s end user, reports in the developing countries language and quality assurance of that language.
After reading your post, it does not sound like a very good place to work and I hope you find a much happier place to work.

The companies exploited the loop holes as there are no proper checks in place in the h1’s native country. I came across a person in the US who did not even graduate from college but had a fake degree. He owns a house, green card and maybe a citizen in future. This is not limited to one particular country but across the globe where crooks exist and frauds take place.

Once proven fake, take all the monies and possession acquired during his stay in the USA and send them back to India (more than 70% could be going home). #21 I agree, I was in Chennai before for an offshore project. I’ve seen in the streets fake Diplomas, Certificates being sold legally. Gosh you could even have a masters degree in minutes, it’s a do while you wait thing. I should have bought multiple degrees when i was there, engineering, medicine and law. I just don’t know which one should i use after (LOL).

There is crime everywhere in all kinds of society and at the same time there are honest and good people everywhere.
So stop going ga ga about the fraudulent companies. I am an H1B employee I know how hard it was to get a 4 year computer science degree.
Everyday was really tough. After such a huge effort I am earning the fruits now.
At the same time I know some people who took 8 years to complete their degree and came to US with no effort at all they had 0 years experience obviously they faked the experience
Dont worry, everywhere their is good and bad. Lets move on.

Foreign-born engineers and computer scientists have been critical to growth and innovation in the U.S., according to a study by The Kauffman Foundation (kauffman.org), Duke University, New York University and Harvard. Economics 101- H1b wages and outsourcing wages depressed wages globally for IT workers and other fields. As supply of immigrants and outsourcing shops grew, prices for wages fell. The oversupply of immigrants without work in the United States, led to the return of the immigrants to their countries of origin. (Please note : corruption and other factors were also evident, as shown with the US arrests).
Due to false promises, a coined term “globilization” that had failed before, which the immigrants believed, and the outsourcing of work to countries of the immigrants origin, demand for workers grew in the country of origin, thus the immigrant workers went back where the work existed. Please note that some outsourcing companies quest to find an illusion of lowest cost (not necessarily the best quality and ultimately not the lowest cost), placed plants and services in the immigrants country of origin. The worker went back to the country of origin where the work existed.
Because a country can only sustain a population that it can responsibly educate and feed, limits on visas were correct.
These limits were especially necessary due to the depression of 2008-2009 when unemployment soared. The US workers were already highly educated and skilled as in the case of the IT worker. The trades workers were also experiencing the same shortage of jobs in the United States. Thousands of businesses
had been started by US persons during this same time period, small, medium and large.
This has happened before, see the Williams and Mary study (railroad bust).
It would be good , if this author told both sides of the story. Globalization includes the United States workers. Author: what was the impact to the US workers and inventors? What was the difference in the educational standards of the immigrants country? Why were their false documents? What was the impact to the other classes of workers, women, older higher paid workers, young graduating workers?
Tell the whole story.
Some immigrants helped found companies in the United States, but by 2009, all of these companies fell. This crash in stock of the companies mentioned in this research report, as of this writing is 50%- 80% down from their peaks. This downward spiral is continueing because of the lack of jobs, depressed wages, and ultimately the depressed buying power of the US citizen and the immigrants.

Most of these guys use a fake argument that Indian IT consultants on H1B are talented ones and that the US economy will suffer without them. It is not true. US economy and technology were doing excellent without them for centuries.In fact we started having problems only after thay came in. Most of the H1Bs that arrive using H1B channel are fraud with fake degrees and resumes. Off shoring for a lower cost is another fraud. They do offer offshoring with a consultant for less than $30 an hour but slowly they keep adding more offshore consultants say 4 or 5 increasing the cost to more than $120 an hour. What americans doesn’t know is the same consultant takes up 4 or 5 different IDs and the company starts milking money. Poor Americans think that for 4 consultants they have reduced the cost by 75% whereas they don’t need 4 people and infact even the single consultant with 4 Avatars is alreay working for 4 different clients on offshore.
So there is no actual cost saving and the american businesses have to probe deeply and avoid employing H1Bs and offshoring. Also employing H1Bs on contract through Indian IT consultants also should stop.
US economy can do better without them as we have proved in the past. We had many innovations before they came here.

I am an indian immigrant and now a US citizen and I hate this H1 culture that has been created by these fake people. There may be a few talented ones but majority are fake low lives. I cringe sometimes to see them as fellow indians. And don’t blame the companies. One has to pay bribes to these companies to get an H1 and these cockraches don’t hesitate to come up with fake degrees/experience. Send them home immediately. There are legal ways to obtain a residency in the US and I waited 12 yrs to do just that. If you are willing to play by rules of this land and want to immigrate get in line at the consulate just like I did and many law abiding people with morals. And to all of you morans who think Ameirca can not survive without H1B roaches you are so foolish and stupid to think that. time to shut down the door to all kinds of cheaters, not just those well-known Indian H1b fraud. The percentage of cheating cases among Indian H1b applicants is too high. I saw in various companies, Indian workers are dominant in the departments like QA or testing, since anyboady is qualified for those, why don’t hire Americans for QA/testing?
They import more cheating politics into our companies as well, e.g. steal other people’s credit, amplify the tiny things they have done if any, crank the big fancy and useless reports to sweet the high level managers etc.
of course there are some good Indian engineers, the percentage is far less than 50%, let’s put a limit for Indian companies/engineers for H1b, say 5000 max each year for all of them. Let themselves kick out those bad ones, we don’t have the money to do this right now. Goodies are needed as always.

Yes, American jobs should be given to Americans and not to foreigners. All American companies and banks should do their business in US. American are self made people no country of the world should be allowed to trade with America as there products / services are not up to mark of American (In other words we should cancle all the trade treaty with any country), World Bank should not be allowerd to deal with America as thay are not 100% American and US should ban any foreigners to their universities, China should be banned for exporting anything to Arerican as there products are not good in quality and standard as per Americans, Mexico should be banned for automobile service and India for IT service, America should send back all those who migrated from different parts of the world and leave this land of opportunity to it’s natives – the aborigines.
BTW –> There are few companies like google, yahoo, hotmail etc etc where American citizens are working. Aren’t they patriotic, they should resign from these companies as there founder are immigrants….
Just observing this tread and how people of this great land spit venom in the times of crisis.

Anyone realizes that american companies like coke, pepsi etc are running business globally and daily earning billions of $$$ and that money is coming in this country and indirectly to goverment and citizens of this country.

This company is going down the drain, As long as it is run by Shailesh and Archana Ardhapurkar, the duo rule the company. They have ruined the lives of the entire workforce. These two single handedly make irrational decisions and fail to live up to their commitment and literally push the employees over the edge. Shailesh does not know how to handle complex issues and has no professionalism and needs to know how to send porper, professional emails. Instead of acknowledging the work put in by their employees, they demoralize them. Archana does not know how to talk without being rude and harsh with her responses.
News in the market is that the duo has opened another company partnering with an ex employee who was fired for lack of performance. The consultants who are on project are now being referred to that company. Vision now has a bad reputation thanks to the mishandling by the duo.
HOPEFULLY THIS WILL BE AN EYE OPENER FOR THE MANDALAPU BROTHERS WHO HAVE SUCH BLIND FAITH IN THE “ARDHAPURKAR’S”.

Looks like someone has a sure sympathy for Mandalapu brothers. The origin of this case is from IOWA and had nothing to do with the names mentioned; they joined pretty late in the game and have no role to play in immigration.
Unless this is Mandalapur borthers who are writing this, its a different story but I know these guys for last 6 months and the story is different.
Back to the main point, if the H1B program is exploited, it should be looked into now and for every organization. That should not be spared for any IT staffing company.

I found a US based indian IT company supplying fake salaray slips for the H1B candidates in india for last six months, is that fraud ? if yes where can i report about this company ?
candidates using this salary slips and other experience certificates supplied by this company for applying jobs in India asking for huge salaries showing their fake exp…is this fraud if yes where can i report about this company ?

It is not only for software based work that H1-B visas are hired.
Have you even heard of fields like Ocean engineering, Naval architecture, genetic engineering, biotechnology, analog design???
There might be more such fields, I know only these coz I have friends in all the above mentioned fields (all H1-Bs, everyone from prestigious US universities and most of them say that when they were in grad school there was not even a single American in their class).
All of them work for really rich companies and get 6 figure salaries, 5 figure bonuses and have 4-5 bedroom houses …drive Mercedes/bmw or Audis..
They didn’t make all these by snatching any American’s job. They are hard working, intelligent and have masters and/or Ph.d’s from prestigious universities.
Just bashing the H1-B’s or getting jealous won’t get you anywhere.
Try to make the high-schools better.. the high-school drop out rate is 27% in US …
The universities are awesome – agreed. But how can you good students if you drop out of high-school?
That the reason International students fill up the universities and get H1-B’s and get great jobs and make great money.
The software people on H1-B’s and fraud H1-B’s are just a small percent of the whole pool of H1-B’s.
