New NY law gives workers more advance notice of layoffs

As of Sunday, more New York employers will have to give workers a heads-up about a proposed plant closing or mass layoff, and give the notices much earlier.

The state Worker Adjustment and Retraining Notification act, or WARN, is a tougher version of a federal law with the same name:

  • It covers companies with at least 50 full-time employees, versus 100 under the federal law.
  • It requires at least a 90-day written advance notice for a mass layoff or plant closing, versus 60 days under the federal statute.
  • It is triggered when at least 25 employees are laid off, if they make up 33 percent of the workforce, or when a company lays off at least 250 full-time employees. That contrasts with the federal provision, which is triggered when a company lays off 500 employees or 50 to 499 workers, if they make up at least 33 percent of the workforce.

There could be more layoffs than WARN notices show.

According to Wilmington News Journal, several loopholes exist in the Worker Adjustment and Retraining Notification (WARN) Act that companies have used to get around notifying workers and their communities about large layoffs. For example, if a company could have a 100 people at several locations spread out across the country, and if they lay off 20 people at each location, that gets past the WARN act.

Other loopholes exist: companies totaling under 100 employees are exempted from the law. If a layoff is done gradually — where under 50 employees are laid off per month — it does not have to be reported. If displaced workers are planning to be hired again within six months, no reporting is necessary. Part-time workers employed under 20 hours per week do not have to be included in a count.

WaMu to lay off 3,400 in January

According to WARN filing with WA Employment Security Department, Washington Mutual is scheduled to lay off 3,400 workers in Seattle starting 1/31/2009

Other notable layoffs include Kenworth Trucking (430 employees, starting 1/16/09) and Hunter Douglas (166 employees, starting 2/2/09). American Airlines to lay off 1.
